4140 - RESIGNATION

The classified staff member should recognize the obligation to faithfully fulfill the terms of his/her contract until it is dissolved by mutual consent or by due process of law.

The classified staff member shall not resign to accept a new position elsewhere during a school year until a suitable replacement is available or until every reasonable opportunity has been made to secure a suitable replacement.

The Board of Education shall release a staff member from the terms of a contract when an opportunity is offered for significant advancement.

A classified staff member intending to resign should submit a written resignation to the Superintendent as far as possible in advance of the effective date of resignation.

The Superintendent shall, whenever possible, conduct an interview with the employee to determine the reasons leading up to the resignation.

Whenever a classified employee in a position requiring a license resigns because of or in the course of an investigation wherein it is reasonably believed that such employee has engaged in conduct unbecoming the teaching profession, the Superintendent shall immediately take steps to assure that a report of such conduct is made to the State Department in conformance with Policy 8141.
