7440.01 - TRESPASSING ON, OR DAMAGING OF, SCHOOL PROPERTY
Part I
Ohio Revised Code Section 2911.21 and Section 505.04 of the Codified Ordinances of Upper Arlington provide:| A. | No person, without privilege to do so, shall do any of the following: | ||
| B. | It is no defense to a charge under this section that the land or premises involved was owned, controlled, or in custody of a public agency. | ||
| C. | It is no defense to a charge under this section that the offender was authorized to enter or remain on the land or premises involved, when such authorization was secured by deception. | ||
| D. | Whoever violates this section is guilty of criminal trespass, a misdemeanor of the fourth degree. | ||
| E. | As used in this section, "land or premises" includes any land, building, structure, or place belonging to, controlled by, or in custody of another, and any separate enclosure by deception. | ||
| "Signage giving notice of the rules established in this Part I of this Regulation shall be posted conspicuously at or near the entrance of school grounds or premises, or near the perimeter of school grounds or premises if there are no formal entrances, and at the main entrance to each school building." |
All persons, except those defined below, upon entering any school building during the hours of 7:00 a.m. to 6:00 p.m. on a school day – when students or child care participants may be present for regular school, child care, or pre- or post-school student activities – must report to the main office of the building or to such other location therein as has been designated, and request a visiting permit, and appropriate notices of this restriction and any designated location(s) for so reporting shall be posted at each entrance of each affected building. Absent so reporting and obtaining permission to be present, no person, except those defined below, is authorized during the hours set forth above to enter or remain in the building or otherwise upon the school property upon which the building is located.
The above provisions shall not be applicable to students and to employees assigned to the building; persons who have been authorized by the Superintendent to enter any such building for professional or business purposes; or persons who are attending a regularly scheduled meeting, conference or other event approved by the principal or by another school official duly authorized to grant such approval.
Prior or subsequent to the hours of 7:00 a.m. to 6:00 p.m. on a school day, and during any hours on other days, only employees who are working at their regular assigned duties and persons who are attending regularly scheduled school activities or other events for which formal Board approval has been issued, or who have been granted permission by the building principal or another school official duly authorized so to grant permission, are authorized to be on school property.
Part II
Persons or organizations guilty of, or otherwise having responsibility or liability for, damaging school property or committing any other offense against school property shall be required to pay in full all damages and shall be subject to all laws pertaining to such offense.
Identifiable incidents of such damaging shall be reported and recorded in a manner to allow for the assessment of the problem for the District.
