5600.01 - STUDENT DISCIPLINE - SCHOOL SAFETY BILL
The Board of Education hereby enacts the following changes to Admissions, Student Conduct, Suspension, Expulsion, Student Discipline, Postsecondary Enrollment, and all other policies of the Board relating to student discipline, said policy shall apply regardless of any other provisions of such policies:
| A. | Suspensions may be imposed not only by the Superintendent, but also by the Director, Dean of Students, and Supervisor of Attendance. | ||
| B. | The notice and hearing procedures for suspensions and expulsions shall not be required for in-school suspensions. In-school suspensions will be served entirely in a school setting. | ||
| C. | The Superintendent shall expel for up to one (1) year and, on a case-by-case basis, may reduce the period of expulsion for a student who brings a firearm or knife to an interscholastic competition, extra-curricular event, or any other program or activity that is not located in a school or on property that is owned or controlled by the District, or who possesses a firearm or knife at a school, on any other property owned or controlled by the Board, or at interscholastic competition, an extra-curricular event, or any other school program or activity, which firearm or knife was initially brought onto School Board property by another person. Any reduction of an expulsion herein shall be under the same standards that the policy permits a reduction of expulsions for bringing a firearm to school. | ||
| D. | The Superintendent may expel a student from school for a period not to exceed one (1) year for committing an act that would be a criminal offense if committed by an adult and that results in serious physical harm to persons or property, as defined in R.C. 2901.01, if the act is committed at school, on any other property owned or controlled by the Board, or at any interscholastic competition, extra-curricular event, or other school program or activity. The reasons for which the Superintendent may, on a case'-by-case expulsion may be reduced under the Student Discipline Policy. | ||
| E. | All types of misconduct described in the Student Discipline Policy may be punished under that policy even if the misconduct occurs off of school property as long as the misconduct is connected to activities or incidents that have occurred on property owned or controlled by the School District. | ||
| F. | All types of misconduct described in the Student Discipline Policy may be punished under that policy, regardless of where the misconduct occurs, if the misconduct is directed at an employee or officer of the School District or at the property of an employee or official of the School District. | ||
| G. | Students shall be denied high school credit for an postsecondary course taken under the postsecondary enrollment options program if any portion of the course was taken during the period of an expulsion. | ||
| H. | A student who would otherwise be eligible to attend the Trumbull Career and Technical Center but who has been suspended from another public school in Ohio, or expelled from another public school in Ohio or from an out-of-state public school, may be temporarily be denied admission for the unexpired period of suspension or expulsion. Prior to denying the student admission, the student will be provided with an opportunity for a hearing. The student will be admitted at the expiration of the suspension or expulsion. | ||
| I. | The Superintendent shall initiate proceedings against a student who has committed an act that warrants expulsion even if the student withdraws or attempts to withdraw from school at any time after the act or occurrence which resulted in the disciplinary referral. Following the expulsion hearing, if the Superintendent determines that expulsion is warranted, the term of that expulsion will be unaffected by the withdrawal of the student. |
