5722.01 - DISTRIBUTION OF INFORMATIONAL MATERIAL

Policy:

It is the policy of the Sylvania Schools to assist community groups by helping distribute to the families of students informational material regarding community activities and events that are relevant to the students and parents.

General Principles:

Informational material distributed under this policy must be related to school activities or programs or to community activities that are relevant to the educational mission of the Sylvania Schools and to it students and their parents.

The distribution of informational material under this policy must occur at a time and place and in a manner that will not disrupt the operation or interfere with the activities and programs of the Schools and that is not coercive.

Informational material distributed under this policy must not state or suggest that the material or the activity or event described in the material is sponsored or endorsed by the Sylvania Schools.

This Policy does not permit the distribution of partisan informational material pertaining to a school or general election, budget or bond issues, or labor negotiations, pertaining to activities sponsored by or associated with an individual or a for-profit organization, or pertaining to the effort of another public, parochial, or independent school or school system to recruit or solicit Sylvania School students to enroll in that school or a school in that system.

The Policy does not permit the distribution of informational material that is designed to raise money or promote fund-raising activities, except for events sponsored by parent organizations as authorized by the Superintendent.

This Policy does not permit the distribution of informational material that conflicts with the educational program of the Sylvania Schools or promote illegal conduct, violence, or hatred, or that otherwise presents a realistic danger to the health and welfare of Sylvania Schools students.

Rules and Procedure:

 A.All informational material distributed under this Policy must first be approved by the Superintendent of Sylvania Schools. The Superintendent may delegate this function, or any other function prescribed under this Policy.

 B.To provide sufficient time for the review of informational materials before distribution, an organization desiring distribution of material under this policy must submit the material to the Superintendent at least one (1) week before the desired date for distribution. If for unforeseen reasons this deadline cannot be met the Superintendent may agree to waive the period and shorten the time for review.

 C.Material submitted for distribution under this Policy must contain the name of the sponsoring organization and the name and telephone number of a responsible individual associated with that organization.

 D.Before approving distribution, the Superintendent must review the material to ensure compliance with this Policy.

  1.To ensure compliance with this Policy, the Superintendent may require the flyer to include an explicit statement that the activity or event described in the material is not sponsored or endorsed by the Sylvania Schools.

  2.To ensure compliance with this Policy, the Superintendent may take any measures that are reasonably necessary to ensure that the activity or event described in the material, and sponsoring organization, comply with the General Principles stated above.

 E.If the Superintendent concludes that the material does not comply with the Policy, the Superintendent will inform the organization of the Superintendent's conclusion and the reasons for it.

  1.The organization may attempt to correct the problems identified by the Superintendent and resubmit the material for approval.

  2.The organization may request a meeting with the Superintendent to discuss the matter and present the organization's views as to why the material complies with this Policy. If such a meeting is requested, the Superintendent will meet with a representative of the organization, will consider the organization's views, and will as promptly as practicable inform the organization of the Superintendent's conclusion.

 F.If the Superintendent approves distribution of the material, the Superintendent will contact the organization to make appropriate arrangements for distribution.

 G.The Superintendent may adopt additional rules and regulations for the implementation of this Policy throughout the Sylvania Schools.
