5111.01 - POSTPONING ADMISSION OF STUDENTSEXPELLED BY OTHER DISTRICTS

The Superintendent may refuse to admit to the schools of this District any student who has been expelled from the schools of another district within or outside this State during the remaining period of such expulsion. Upon completion of any period of expulsion, the student will be admitted to the schools of this District under the same conditions as other students.

Before refusing admission, the Superintendent or Superintendent’s designee will conduct a hearing at which the student and/or the student’s parent, custodian, or guardian will be permitted to show that the student is not currently expelled from the schools of another district or to explain any factors which they may ask the Superintendent or designee to consider when deciding whether to admit the student. The Superintendent or designee will not re-examine the prior decision to expel the student but only whether to admit the student to the schools of this District prior to the expiration of the expulsion period.

The student and, if the student is under eighteen (18) years of age, the student’s parent, custodian, or guardian will be given oral and/or written notice of the time, place, and purpose of the hearing at least twenty-four (24) hours in advance of the scheduled hearing. The notice period may be shortened upon request of the parent, custodian, or guardian, or upon request of the student if s/he is at least eighteen (18) years of age. The parent, custodian, or guardian, or the student is at least eighteen (18) years of age, may request a postponement of the hearing, but the student shall not be admitted to the schools of this District during the period of delay.

If a student is admitted to the schools of this District, and upon the District’s receipt of student records from the school(s) which the student previously attended it is discovered that the student is currently expelled from the schools of another district, the student will be temporarily removed from school pending the hearing described above.

Upon conclusion of the hearing, the Superintendent or designee will provide the student and parent, custodian, or guardian with written notice whether the student will be admitted to school.
