3124.02 - EMPLOYMENT OF EXEMPT EMPLOYEES

Terms of Employment

It is the intention of the Board of Education ordinarily to employ Exempt Employees in a manner that will provide continuity of exempt employment services during a school year and, to the extent feasible, from year to year.

Duties and Qualifications

Exempt employees shall be employed in identified positions, the duties of which are scheduled over a portion of the year as shall be determined by the calendar established by the Board. The duties incident to each position shall be set forth in a job description adopted by the Board which may be amended from time to time, a copy of which shall be maintained in the incumbent employee's personnel file. The Board shall not transfer an Exempt Employee to a position of lesser responsibility during his/her employment except by mutual agreement.

Compensation

Compensation for services rendered by Exempt Employees will be determined pursuant to the Exempt Employee salary schedule as in effect from time to time, a copy of the current version of which will be appended to this policy.

The Board and the Exempt Employee may mutually agree to adjust the salary during employment but it is intended that Exempt Employees not be paid less than the salary established pursuant to Section 3.01 above unless such adjustment is part of a uniform plan affecting all Exempt/Administrative Employees of the Board. Placement on the salary schedule will be at the discretion of the Superintendent. Step increase on the salary schedule will be made August 1st of each year. The base amount will be adjusted commensurate with increases provided classified staff.

BENEFITS

Vacation

The Exempt Employee shall be entitled to twenty (20) vacation days per year of employment. The Exempt Employee shall be compensated for accrued and unused vacation days at separation of retirement at his/her current salary rate, up to the amount accrued and unused within three (3) years prior to separation or retirement. In the case of death of an Exempt Employee, the compensation shall be made to the estate of the deceased.

Holidays

The Exempt Employee shall be entitled to the following paid holidays during each year of employment:

Sick Leave

All Exempt Employees shall be granted sick leave without loss of pay for absence due to personal illness, family illness, or bereavement. In case of such absence the days of the absence will be deducted from the Exempt Employee's accumulated sick leave.

Sick leave shall be granted to Exempt Employees at the rate of one and one-fourth (1 1/4) days per month. Sick leave shall accumulate at the rate of fifteen (15) days per year to a maximum of 330 days.

Any Exempt Employee with five (5) years experience in the School District who, at the date of retirement (retirement meaning at least fifty (55) years of age or at least thirty (30) years of service) has expressed in writing his/her intent to permanently discontinue active service with any agency of the State government will at that time receive a lump sum payment equivalent to one-third (1/3) of the total accumulated sick leave days at the current salary rate to a maximum of 108 days for twelve (12) month employees and 100 days for ten (10) month employees.

Any Exempt Employee with seven (7) or more years of experience in the School District, shall upon resignation for reasons other than those defined by 3319.16 RC or qualified retirement, receive a lump sum payment equivalent to one-third (1/3) of the total accumulated sick leave days at the current salary rate to a maximum of eighty-five (85) days for twelve (12) month employees and sixty-five (65) days for ten (10) month employees.

Any Exempt Employee with five (5) years experience in the School District who qualifies for regular or disability retirement as defined by S.T.R.S. or S.E.R.S. requirements may be offered an early retirement incentive payment of up to $10,000 by the Superintendent with the approval of the Board of Education.

In case of the death of an Exempt Employee who qualifies for retirement and has remained in service, the lump sum payment will be made to the estate of the deceased.

Benefits in Addition to Salary

Exempt Employees shall be compensated for accrued and unused vacation days at separation or retirement at his/her current salary rate up to the amount accrued and unused within three (3) years prior to separation or retirement. In case of death of an Exempt Employee the compensation shall be made to the estate of the deceased.

Authorized overtime shall be compensated at the rate of time and one-half (1 1/2) for all hours over eight (8) in one (1) day. All hours over forty (40) in one (1) work week shall be paid at the rate of time and one-half (1 1/2). All Saturday work shall be paid at time and one-half (1 1/2). All work performed on Sunday shall be paid at the rate of double time. (Double time shall be defined as straight time pay in addition to the employee's regular hourly rate.) All work performed on a holiday shall be paid at the rate of triple time. (Triple time shall be defined as the regular holiday pay in addition to double the employee's regular hourly rate of pay for hours worked.)

Whenever schools are closed due to Board declared calamity or delay day, an Exempt Employee shall report to work only if his/her immediate supervisor directs him/her to report. An Exempt Employee shall be paid his/her contracted salary for a calamity day regardless of whether or not s/he works on that day. An Exempt Employee shall be paid for delay time provided said employee works the remainder of his/her hours on delay days and provided the employee reports on the delay day at the time directed by his/her supervisor. In additional, an Exempt Employee required to work on a calamity day shall be paid at his/her straight time rate for hours worked up to eight (8) hours and one (1) hour hazardous travel pay. Hours worked upon the request of the immediate supervisor in excess of eight (8) hours or hours worked outside the regular assigned shift shall be paid at the time and one-half (1 1/2) rate.

Exempt Employees who enroll in a course or workshop related to their duties and responsibilities shall, with prior approval of the assistant superintendent, receive full reimbursement for tuition, fees, and required material costs for such courses or workshops.

Personal Leave

All Exempt Employees shall be granted up to three (3) days of leave each year without loss of salary to transact necessary personal business or attend to affairs of personal nature which cannot be conducted outside the regular school day. Arrangements to be absent shall be made by specific arrangement with his/her immediate supervisor.

Exempt Employees having unused personal days as of August 1st of each year may choose to have these days credited to accumulated sick leave or accumulated up to ten (10) days.

Insurance

Exempt Employees shall be afforded comparable hospital/surgical insurance benefits as accorded other professional staff members.

The Board shall purchase from a carrier licensed by the State of Ohio, Group term life insurance to the nearest thousand for each Exempt Employee equal to one and one-half (1 1/2) of that employee's annual salary, plus an equal amount of accidental death and dismemberment coverage. The full cost of this program and any increases thereof, shall be paid by the Board. Exempt Employees shall be afforded comparable dental insurance benefits as accorded other professional staff members. Exempt employees shall be afforded comparable family prescription drug insurance benefits as accorded other professional staff members.

Mileage

Exempt Employees shall be reimbursed for expenses incurred in the performance of their regular duties including necessary use of private vehicles at the rate currently established by the Board of Education Necessary usage of an automobile will include any functions in which the Exempt Employee is obligated or committed to use his/her personal vehicle to carry out District or school duties. Payment will not be made for travel from residence to first duty building or from last duty building to residence. In travel of any distance in which a personal vehicle is used, Exempt Employees will make every reasonable effort to share rides.

Leave of Absence

Exempt Employees may make arrangement to be absent from duty for reasons of personal emergency by specific arrangement with the Superintendent.

Retirement

The amount of the employee's contribution to the School Employees Retirement System (SERS), heretofore, be picked up by the Board of Education (annuity). The Board of Education shall pay the Exempt Employee's contribution to the School Employees Retirement System up to a maximum of eight percent (8%).

EVALUATION

The Board of Education and the Exempt Employees recognize the importance of a regular, objective and positive evaluation procedure. The evaluation shall be considered by the Board of Education in deciding whether to continue employment of an Exempt Employee and shall measure each Exempt Employee's effectiveness in performing the duties included in his/her job description.

The evaluation shall be a written process including discussion of the evaluation between the Exempt Employee and the evaluator. A copy of same shall be placed in the Exempt Employee personnel file to be held in confidence and to be treated in an ethical manner. The establishment of this evaluation procedure does not create an expectancy of continued employment. The Board of Education makes the final determination regarding the continuation of employment of any Exempt Employee. The evaluation process shall be conducted by the administrator(s) designated from time to time by the Board of Education.

MISCELLANEOUS

In the event that any provision contained herein is determined to be in violation of law, such provision shall be void and of no affect provided, however, the remainder of this policy shall continue in full force and effect. Such illegal provision shall be amended so as to ensure compliance with law. This policy shall be governed and construed in accordance with the laws of the State of Ohio.
