3435 - SICK AND EXTENDED LEAVE FOR PREGNANCY

The Board of Education shall provide for leaves of absence, in accordance with law and the policies of this Board and AG 3430, for any employee of this District not otherwise covered by the terms of a negotiated agreement whose absence from duties will be required for a foreseeable event of disability such as childbirth or surgery. Such provisions shall be governed by considerations for the health of employees, the need for continuity in classroom instruction and school operations, and the maintenance of a qualified District staff.

Maternity Leave

An employee who wishes to secure a maternity leave must submit to the Superintendent's Office by the end of her sixth (6th) month of pregnancy a physician's statement which identifies the date the leave of absence is to commence, and which attests to the employee's ability to continue performing the full schedule of her duties and responsibilities while she is still on the job.

An employee must notify the Superintendent by April 10 of the year in which; the leave of absence is to expire. The notification must be in writing. If notification in writing is not received by the deadline date of April 10, the employee shall be deemed to have resigned.

The Board reserves the right, on the advice of the employee's physician, to specify the point at which such leave shall commence, the length of time for which leave shall continue after the disabling event and the conditions of pay during such leave. The Board shall require disclosure of anticipated disability and the continuing certification of an employees fitness to perform duties thereafter.
