1240.01 - NON-REEMPLOYMENT OF THE EXECUTIVE DIRECTOR
The Board of Directors has an obligation to the customers of this Council to employ the professional leadership best trained and equipped to meet the program needs of the Council. It shall meet that obligation by retaining only the best qualified person as Executive Director.
If the services of the Executive Director are found to be unsatisfactory to the Board, s/he shall be notified by the Board Chairperson and given an opportunity to correct the conditions.
If his/her services continue to be unsatisfactory, the Executive Director shall be notified in writing by the Board Chairperson, as approved by the Board. Notification of its intent not to reemploy his/her services shall be given in accordance with the Executive Director's contract.
Reporting Professional Misconduct
Consistent with Policy 8141 and State law, the Board will file a report to the Ohio Department of Education, on forms provided for that purpose, matters of professional misconduct on the part of the Executive Director, if s/he is a licensed professional, including a conviction of the Executive Director of certain enumerated crimes and/or conduct which is determined to be unbecoming to the teaching profession. Reports of any investigation regarding whether or not the Executive Director has committed an act or offense for which the Board would be required to make a report to the Ohio Department of Education, if it were a school district board of education, shall be kept in the personnel file of the Executive Director. Should the Ohio Department of Education determine that the results of that investigation do not warrant initiating an action suspending, revoking, or otherwise limiting the Executive Director's license, the report(s) of any investigation will be moved to a separate public file.
