8310 - PUBLIC RECORDS

It shall be the policy of the Mount Clemens Community School District to maintain the public records of this District and to make such records available to residents of Michigan for inspection and reproduction, and to all other governmental agencies entitled thereto, including any and all obligations required by Section 14303(a)(6)(B) of Title XIV of the Elementary and Secondary Education Act (ESEA)(20 U.S.C. Section 8853 (a)(6)(B), and Office of Management and Budget Circular A-87 "Cost Principles for State, Local and Indian Tribal Governments":

 A.Where employees are expected to work solely on a single Federal award or cost objective, charges for their salaries and wages will be supported by periodic certifications that the employees worked solely on that program for the period covered by the certification. These certifications will be prepared at least semi-annually and will be signed by the employees or supervisory official having first hand knowledge of the work performed by the employee.

 B.Where employees work on multiple activities or cost objectives, a distribution of their salaries or wages will be supported by personnel activity or equivalent documentation which meets the standards in subsection (5) of the circular, unless a statistical sampling system (see subsection (6), or other substitute system has been approved by the cognizant Federal agency. Such documentary support will be required where employees work on more than one Federal award, a Federal award and a non-Federal award, two (2) or more indirect activities which are allocated using different allocation bases, or an unallowable activity and direct or indirect cost activity.

All public school records, including accounting and purchasing records, payroll records, equal employment opportunity records, personnel and employment records, election data, legal documents, municipal finance and bonding data, budget data, student activities, athletics, bookstore, transportation and school lunch data, financial reporting data, (including wage and salary records for employees assigned to Title I programs; fringe benefit expenditures, supplies expenditures; time records, certifications of employees assigned to provide Title I services that such services were actually provided, and all other financial records required of Title I recipients); State categorical grants and Federal financial aid grants and financial records maintained in accordance therewith, correspondence, student education records, student accounting records and all other School District records shall be maintained and retained in accordance with the "Schedule for retention and disposal of public school records" (Bulletin N. 522, revised) promulgated by the Michigan Department of Education, which is incorporated herein as if set forth word for word. All such records shall be maintained and provided to the Secretary of the United States Department of Education, or his/her designee in accordance with section 14303.

No original copy of any public record may be removed from the office in which it is maintained, except in furtherance of District business, or by order of a court of competent jurisdiction.

This policy exempts from disclosure all or more than four (4) sequential digits of a social security number contained in a public record.

The Board of Education exempts from disclosure information that, if released, would prevent the School District from complying with section 444 of subpart 4 of part C of the General Education Provisions Act, Title IV of Public Law 90-247, 20 U.S.C. 1232g, commonly referred to as the Family Educational Rights and Privacy Act of 1974. The Board of Education also exempts from disclosure directory information, as defined by section 444 of subpart 4 of part C of the General Education Provisions Act, Title IV of Public Law 90-247, 20 U.S.C. 1232g, commonly referred to as the Family Educational Rights and Privacy Act of 1974, requested for the purpose of surveys, marketing, or solicitation, unless the Superintendent determines that the use is consistent with the School District's educational mission and beneficial to the affected students. The School District will take steps to ensure that directory information disclosed under this subsection shall not be used, rented, or sold for the purpose of surveys, marketing, or solicitation. Before disclosing the directory information, the School District will require the requestor to execute an affidavit stating that directory information provided under this subsection shall not be used, rented, or sold for the purpose of surveys, marketing, or solicitation.

The Superintendent is responsible for transmission of data contained in the single record student data base established by the Michigan Department of Education. Such transmission shall be in accordance with the procedures established by the Macomb Intermediate School District and the Center for Educational Performance and Information (CEPI).
