4150 - DISCIPLINARY ACTIONS
In the event of an infraction of District rules by a classified employee, it shall be the policy of the Board of Education to apply the statutes of the State, these policies and the guidelines of the District with equal consideration to each classified employee.
The Board reserves the right, within law, to impose penalties for disciplinary reasons. However, where a classified employee fails or refuses to perform contracted work without acceptable reason, the Superintendent may deduct, without further authorization, wages reasonably related to the time not worked.
The Superintendent shall prepare disciplinary rules for situations most often encountered which provide for progressive penalties which include, where appropriate, verbal warning, written warning, suspension without pay, and dismissal.
In the event that it is necessary to take disciplinary action against a classified employee, a notice in ordinary and concise language shall be sent to the classified employee specifying:
| A. | the specific acts and omissions upon which the disciplinary action is based; | ||
| B. | a statement of the cause for the action taken; | ||
| C. | a date when the classified employee may be heard if s/he so wishes. |
The Board authorizes the Superintendent to suspend a classified employee without pay for five (5) or less working days. Longer suspension requires Board ratification.
When immediate dismissal action is indicated, the Superintendent shall recommend to the President of the Board that action be initiated to dismiss the classified employee. If, after being suspended, a classified employee is fully reinstated, said classified employee may receive full pay for the period of suspension depending upon the decision of the Board.
