5330.04 - CARE OF STUDENTS WITH DIABETES

A diabetes care plan ("DCP") shall be prepared and implemented for students who seek assistance with diabetes care in the school setting, unless the student has been managing his or her diabetes care in the school setting before December 1, 2010, which is the effective date of the Care of Students with Diabetes Act in which case the student’s parent or guardian may sign and submit a DCP. The District will not deny a student access to any school or school-related activities on the basis that a student has diabetes and will not restrict the assignment of a student with diabetes to a particular school on the basis that the school does not have a full-time school nurse.

The DCP shall set forth the diabetes-related services for students who need them at school, school-sponsored activities and school-sponsored events as well as the appropriate staff that will provide and supervise such services. The DCP is to be the basis for the Section 504 plan for any student seeking diabetes care at school. For students with diabetes who are otherwise eligible for a Section 504 plan and/or an IEP for reasons other than or in addition to the student’s diabetes, the DCP shall address the student’s needs based on diabetes in the school setting.

The DCP shall include the health care provider’s instructions and must:

 A.be reasonable, reflect current standards of care, and ensure safe disposal of syringes and lancets;

 B.include requirements for diet, glucose testing, insulin administration, and treatment for hypoglycemia, hyperglycemia and emergencies;

 C.include a uniform record of glucometer readings and insulin readings by the school nurse or delegated care aide during the school day, which information shall be recorded on the Illinois State Board of Education’s standardized form;

 D.include the process for when the delegated care aide should consult with the parent, school nurse or health care provider to confirm the appropriate dosage of insulin;

 E.include the health care provider’s instructions concerning the student’s diabetes management during the school day, including a copy of the signed prescription and methods of insulin administration;

 F.be signed by the student’s parent or guardian;

 G.include authorizations, if any, for the student’s self-management, including but not limited to: checking blood glucose, administering insulin, treating hypoglycemia or hyperglycemia, possessing all necessary equipment and supplies to treat diabetes;

 H.include information to be provided to school employees who transport the student for school-sponsored activities and events, which shall include a picture of the student, identify potential emergencies that may occur and appropriate responses to such emergencies and include emergency contact information;

 I.include emergency contact information for parents/guardians; and

 J.include parental consent for authorized District representatives to communicate with the health care provider whose instructions are included and to provide the care set forth in the DCP. (See Form 5330.04 F1).

The DCP must be submitted by the parent/guardian to the school at the beginning of the school year, upon enrollment, as soon as practical following a student’s diagnosis or when a student’s care needs change during the school year.

The District, school employees and any delegated care aide are not liable for civil damages related to the care of student with diabetes except for an act or omission amounting to willful or wanton misconduct by the District, employee or delegated care aide. In addition, school employees shall not be subject to any disciplinary proceeding based on any action taken in compliance with the Care for Students with Diabetes Act unless the action constituted willful or wanton misconduct.

In schools that have a student with diabetes, all school employees must receive training in the basics of diabetes care, how to identify when a student with diabetes needs immediate or emergency medication attention, and whom to contact in the case of an emergency. Such training shall be completed by a health care provider with expertise in diabetes or a certified diabetic educator.

In addition, delegated care aides shall be trained to perform the tasks necessary to assist a student with diabetes in accordance with a DCP, including the following:

 A.check blood glucose and record results;

 B.recognize and respond to symptoms of hypoglycemia and hyperglycemia according to the DCP;

 C.estimate the number of carbohydrates in a snack or lunch;

 D.administer insulin in accordance with a DCP and record the amount administered;

 E.emergency response, including the administration of glucagon and contacting 911.
