5120 - ASSIGNMENT WITHIN DISTRICT

The Board of Education directs that the assignment of students to schools within this District be consistent with the best interests of students and the best use of the resources of this District.

The Board shall determine periodically the school attendance areas of the District and shall expect the students within each area to attend the school so designated.

In the event that a student attends a persistently dangerous elementary or secondary public school, or is a victim of a violent crime while in or on school grounds during school hours or during a school sponsored activity, the student will be allowed to transfer to a safe school within the District. To the extent possible, a transferring student will be transferred to a school that is making adequate yearly progress and that has not been identified for school improvement.

The District will use the definition of Persistently Dangerous School and Victim of a Violent Criminal Offense (Individual Option) as defined by the Illinois State Board of Education. The definitions are as follows:

 A.Persistently Dangerous School – for two (2) consecutive years a school must have expelled more than three percent (3%) of the student enrollment for violence-related reasons; have one (1) or more students expelled for having a gun or weapon (as defined in 18 U.S.C. 921) to school; and have three percent (3%) or more of the student enrollment exercising the individual option, as explained below.

 B.Victim of a Violent Criminal Offense (Individual Option) – any individual student who becomes a victim of a violent crime as defined by Illinois Law (725 ILCS 120/3) within the school the student attends or on school grounds of the school the student attends during regular school hours or school-sponsored event, will be allowed to transfer immediately to a different school within the district.

Upon receiving a request for a transfer pursuant to the Unsafe School Choice Option, the building principal will investigate to determine whether the criteria for a transfer have been met.

For any school identified as persistently dangerous by the Illinois State Board of Education, the District will develop and implement a corrective action plan, in accordance with the Illinois State Board of Education's requirements.

The Superintendent shall periodically review existing attendance areas and recommend to the Board such changes as may be justified by:

 A.considerations of safe student transportation and travel;

 B.financial and administrative efficiency;

 C.the effectiveness of the instructional program.

No assignment to classes or attendance schedules shall discriminate against students on the basis of gender, race, religion, disability, or national origin.

The Superintendent shall assign incoming transfer students to such schools, grades, and classes as may afford each student the greatest likelihood of realizing his/her fullest educational potential.

The principal shall assign students in his/her school to appropriate grades, classes, or groups. This action shall be based on consideration of the needs of the student as well as the administration of the school.

A student classified as disabled in the Herrin Community Unit School District No. 4 shall be placed in an educational program which is appropriate to the student's needs and least restrictive of the interaction with nondisabled children. The disabled student may be placed in an educational setting other than the local school district. The disabled student shall be assigned to an educational program based upon recommendations made during a multi-disciplinary staffing through the Williamson County Special Education District.
