3122.01 - DRUG-FREE WORKPLACE
The Board of Education believes that quality education is not possible in an environment affected by drugs.
In compliance with the Drug-Free Workplace Act, the Board prohibits the manufacture, possession, use, distribution, or dispensation of any controlled substance, including alcohol, by any member of the District's professional staff at any time while on District property or while involved in any District-related activity or event. Any staff member who violates this policy shall be subject to disciplinary action, up to and including termination, in accordance with District guidelines and the terms of any applicable
collective bargaining agreements. In addition, any staff member who violates this policy may be subject to participation in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State, or local health enforcement, or other appropriate agency, in accordance with the terms of any applicable collective bargaining agreements and District guidelines.The Superintendent shall establish a drug-free awareness program to inform staff members about the dangers of drug abuse in the workplace; the District’s policy of maintaining a drug-free workplace; any available drug counseling, rehabilitation and employee assistance programs; and the penalties that may be imposed for drug abuse violations. The Superintendent shall provide each staff member a copy of this policy and inform staff members that compliance with this policy is mandatory.
All staff members must notify the Superintendent of any criminal drug statute conviction for a violation that occurred in the workplace within five (5) calendar days of such conviction. The Superintendent will notify the Federal granting agency within ten (10) days of receiving such notice of a conviction from a staff member. Within thirty (30) days of being notified by the staff member of the conviction, disciplinary action will be taken against the staff member or participation in drug abuse rehabilitation, as described above, will be required of the staff member.
