5772 - WEAPONS

Application to Students with Disabilities

This policy shall be applied in a manner consistent with the rights secured under Federal and State law to students who are determined to be eligible for special education program and services.

Weapons, Criminal Sexual Conduct, Arson (Policy 5610)

Students in possession of a dangerous weapon/firearm, or who commit arson, or criminal sexual conduct on District grounds, in District buildings or at District or school-sponsored events shall be expelled from the District and referred to the criminal justice or juvenile delinquency system and the appropriate county department of social services or community mental health agency. The parent, legal guardian and/or student shall also be notified of the referral.

Only the Superintendent may issue an order for an expulsion. Any student expelled (meaning a complete and total severance of the relationship between the student and the District) from the School District by order of the Superintendent shall be given the opportunity for an appeal hearing before the Board, or Committee appointed by the Board President, upon written request for appeal filed with the President of the Board within ten (10) days after receiving the notice of expulsion from the Superintendent. (See Policy 5610, Permanent Expulsion, for procedure details.) If the Board President appoints a Committee for purposes of hearing appeals made in cases of expulsions, the Committee conducting the hearing shall be a member(s) of the Board and also may include representative(s) appointed by the Board, such as an attorney appointed by the Board.

Weapons are identified into two (2) categories:

 A.Articles commonly used or designed to inflict bodily harm and/or to intimidate other persons. Examples are firearms, metal knuckles, knives, chains, clubs, stars, etc.; and

 B.Articles designed for other purposes but which could easily be used to inflict bodily harm and/or intimidate. Examples are belts, combs, pencils, compasses, scissors, etc.
