5610.03 - ASSAULTS COMMITTED BY STUDENTS

Application to Students with Disabilities

This policy shall be applied in a manner consistent with the rights secured under Federal and State law to students who are determined to be eligible for special education program and services.

Assaults Committed Against School Personnel

The Superintendent shall expel a student in grade 6 or above (subject to petition to reinstatement after 180 school days from the date of expulsion) if the student commits a physical assault, as defined by MCL (Michigan Compiled Laws) 380.1311a(12)(b)1, against a District employee or against a person engaged as a volunteer, as defined by Board policy, or contractor for the District on school property, on a school bus or other school related vehicle, or at a school-sponsored activity or event.

Any student in grade 6 or above who commits a verbal assault on school property, on a school bus or other school-related vehicle, or at a school-sponsored activity or event against a person engaged as a volunteer, as defined by Board policy, or contractor for the District shall be suspended or temporarily expelled by the Superintendent for a period of time as determined in the discretion of the Superintendent.

For the purpose of this policy, "verbal assault" shall be defined as any willful verbal threat which is intended to place another in fear of immediate physical contact which will be painful and injurious, with a present intent and ability to execute to act on the threat.

Physical Assaults Committed Against Other Student

The Superintendent shall suspend a student in grade 6 or above for up to 180 or more school days or expel the student, if the student commits a physical assault, as defined by MCL 380.1310(3)(b) against another student on school property, on a school bus or other school-related vehicle, or at a school-sponsored activity or event. The Superintendent may modify the suspension or expulsion on a case-by-case basis.
