5500 - STUDENT CONDUCT
The Board of Education has the legal responsibility to make regulations for the general management of the schools and the preservation of school property. This policy is established to ensure that Intermediate District procedures comply with Federal and State laws and State Board policy as well as current court decisions.
The following basic policy statements apply:
| A. | The Board recognizes that students have legal rights and responsibilities as citizens for special education programs, Genesee Early College and Mott Middle College students pursuant to State and Federal statutes and regulations. | ||
| B. | The Board adopts and incorporates as its policy the Student Code of Conduct and Parent Handbook, Genesee Early College Student/Handbook and Mott Middle College Student Handbook. This code of conduct shall be reviewed periodically. The administration is authorized and directed to develop procedures to maintain a school atmosphere that is conducive to learning. | ||
| C. | The Superintendent or his/her designee may suspend a student from school up to ten (10) days pursuant to the Student Code of Conduct and Parent Handbook, Genesee Early College Student Handbook or Mott Middle College Student Handbook. | ||
| D. | A student may receive a long-term suspension (for any period of time in excess of ten (10) school days not to exceed the balance of the school year) for a violation of the Student Code of Conduct and Parent Handbook, Genesee Early College Student Handbook or Mott Middle College Student Handbook. The Superintendent or designee shall review and approve long-term suspensions. | ||
| E. | Expulsions shall be made by the Board pursuant to Board policy and State and Federal law. Additional procedural requirements for special education students shall be implemented and shall also comply with State and Federal requirements. | ||
| F. | The Superintendent or designee may assist a student and/or a parent who has been issued a long-term suspension or has been expelled in obtaining educational services through another agency. | ||
| G. | Should it be necessary to remove a student from school who presents a dangerous threat to self, other students, school personnel or school property, the Superintendent or designee may file for injunctive relief from a court of competent jurisdiction within ten (10) days of the emergency removal. |
