0362 - SEXUAL AND OTHER FORMS OF HARASSMENT

The Board of Education recognizes that a Board member has the right to work in an environment untainted by sexual or other forms of harassment or discrimination. Offensive conduct which has the purpose or effect of unreasonably interfering with work performance or creating an intimidating, hostile, discriminatory, or offensive educational environment disrupts the educational process and impedes the legitimate pedagogical concerns of the District.

Sexual harassment includes all unwelcome sexual advances, requests for sexual favors, and verbal or physical contacts of a sexual nature whenever submission to such conduct is made a condition of employment or a basis for an employment decision. Other prohibited conduct includes that which has the purpose or effect of creating an intimidating, hostile, discriminatory, or offensive educational environment on the basis of gender, religion, race, color, ethnicity, age, disability, height, weight, marital status, and/or any other legally protected characteristic.

The harassment of a Board member of this District is strictly forbidden. Any employee, student, agent of the Board, or visitor of the District who is found to have harassed a Board member will be subject to discipline in accordance with law and/or the terms of any applicable collective bargaining agreement.

Any Board member who believes he/she has been sexually harassed may report such harassment to any employee of the District. Any employee having received such a report or having other direct or indirect knowledge of a probable violation of this policy shall report details immediately to the building principal or his/her supervisor.

Any person who retaliates in any manner against a person who reports or corroborates the occurrence of sexual harassment or participate in an investigation, proceeding or hearing regarding sexual harassment shall be subject to discipline.

The Superintendent shall ensure that all Board members and agents of this Board shall receive information to enable them to understand this policy and to recognize and correct speech and behavior patterns that may be sexually offensive, whether or not they were intended to offend. A summary of this policy shall be posted in appropriate places and printed in student and parent handbooks.
