5113.01 - INTRA-DISTRICT OPEN ENROLLMENT

Policy Requirements

In accordance with State law (R.C. 3313.97), the Board of education established an intra-district open enrollment policy beginning the 1993-94 school year. The policy applies to New Concord Elementary, Perry Elementary, and Pike Elementary Schools.

The Board believes that whenever possible, students should be permitted to attend the school of their choice within the District. Therefore, students shall be allowed to attend any school of their choice on a first come, first served basis depending upon the number of eligible openings, class size, building enrollment, etc. In implementing the intra-district open enrollment program, the District is not required to:

 A.make alterations in the structure of a requested school or make alterations to the arrangement or function of rooms within a requested school;

 B.establish and offer any particular program in a school if such a program is not already offered in the school;

 C.alter or waive any established eligibility criteria for participation in a particular program including age requirements, course prerequisites and/or required levels of performance.

Application Eligibility and Selection Process

Students within a designated attendance area shall have priority in sufficient time to apply.

Students within a designated attendance area shall have priority in registering in that school. Students may apply for open enrollment in a school outside their attendance area. Such applications shall be approved if there is space available in the requested school and the application has been submitted on or before five (5) school days prior to the start of school in accordance with the regulations accompanying this policy. Applications will be acted upon and all applicants will be notified no later than the Thursday before the first student day of school.

All applications will be decided on a case by case basis, pending number of eligible openings, class size, building enrollment, etc.

All persons whose applications are not honored through the selection process shall be placed on a waiting list to be selected on a first come, first served basis as space becomes available prior to November 1st. After November 1st, no spaces will be filled.

The District will consider move in requests through November 1st. Pending no space available, requests will be added to the waiting list. The waiting list for a given school year is valid only through November 1st. Those persons not accepted through the selection process must reapply each year. Family siblings must be considered on an individual basis.

Approved applications for intra-district open enrollment shall be valid for attendance at that school throughout the grades served by the school.

A transfer request also may be rejected if the special education services specified in the student's IEP are not available at the requested building.

Transportation

Transportation for students granted permission to attend a school outside their attendance area must be furnished by their parent/guardian unless space is available on district buses without disruption of regular routes and loading areas (not including disabled/special education buses and routes).

Nondiscrimination

The Board, the Superintendent, other administrators, and teachers shall not make any distinction on account of race, color, ethnic group, religion, or gender of any student who may be in attendance or who seeks admission to any school under this policy.

Records will be kept of all applications and responses for approval and disapproval of intra-district open enrollment transfer requests.
