4430.01C - SERVICE MEMBER LEAVE – QUALIFYING EXIGENCY
For purposes of allowing Service Member Leave for qualifying exigencies to covered family members of service members, the following definitions will apply:
| A. | Short-notice of Deployment: to address any issue arising from the fact that the covered military member is called to duty on seven (7) days or less notice. | ||
| B. | Military Events and Related Activities: to attend official ceremonies, programs, or events sponsored by the military that are related to the call to duty. | ||
| C. | Childcare and School Activities: to arrange for a change in childcare or schools or provide urgent childcare necessitated by the covered military member's call to duty. | ||
| D. | Financial and Legal Arrangements: to make or update financial or legal arrangements to address the covered military member's absence while on active duty, or to act as the covered military member's representative for purposes of military service benefits. | ||
| E. | Counseling: to attend counseling for oneself, the covered military member, or another eligible family member, provided the need for counseling arises from the covered military member's call to duty. | ||
| F. | Rest and Recuperation: to spend time with a covered military member who is on short-term, temporary, rest and recuperation leave (limited to five (5) days for each instance of rest and recuperation). | ||
| G. | Post-deployment Activities: to attend arrival ceremonies, reintegration briefings and events, and any other official ceremony or program sponsored by the military for a period of ninety (90) days following the termination of the covered military member's active duty status, or to address issues that arise from the death of a covered military member while on active duty. | ||
| H. | Additional Activities: to address other events arising out of a covered military member's call to duty, provided that the Company and employee both agree that it qualifies as an exigency, and agree to the timing and duration of such leave. |
For certification of the qualifying emergency, a HIPAA – compliant form will be used.
