5610.03 - TEACHER SUSPENSION OF STUDENTS

A teacher under contract with Dearborn Public Schools is authorized to immediately remove and suspend a student from a class, subject, or activity when:

 A.The student engages in conduct prohibited by law, Board of Education policy, or the Student Code of Conduct.

B The student’s behavior is so unruly, disruptive, or abusive that it interferes with the teacher’s ability effectively to teach the class, subject, or activity, or the student’s behavior interferes with the ability of other student to learn.

Any student suspended under this policy shall not be allowed to return to the class, subject, or activity from which s/he was suspended until the passage of one (1) full school day. An exception to this would be the case of an elementary school student suspended from his/her regular classroom, in which case the suspension shall be for a minimum of one (1) hour, or a longer period as determined in each case by the teacher and administrator.

In all cases of suspension by a teacher, the teacher shall immediately send the student to the administrator and shall specify in writing the reason for the suspension. The Superintendent shall develop the necessary documentation so that appropriate records are kept. This documentation shall also include a method by which an administrator will report to the teacher the disposition of the student’s case and what further disciplinary actions may have been taken.

As soon as possible, but within twenty-four (24) hours of the suspension, the teacher shall contact the parent or guardian of the student to inform them of the suspension and ask them to attend a parent-teacher conference to discuss the suspension.

This policy shall be applied in a manner consistent with the rights guaranteed under Federal and State law to students who are eligible for special education programs and services.
