9130 - COMPLAINTS CONCERNING SCHOOL PERSONNEL
The Board places trust in its employees and desires to support their actions in such a manner that employees are freed from unnecessary, spiteful, or negative criticisms and complaints.
Whenever a complaint is made directly to the Board as a whole or a Board member as an individual, it shall be referred, in writing, to the school administration for study and possible solution. This notice shall include the name, date, and specific nature of the complaint.
| A. | The individual employee involved shall be advised of the specific nature of the complaint and the date, and shall be given every opportunity for explanation, comment, and presentation of the facts as s/he sees them to the administrator. | ||
| B. | The name of the individual making the complaint shall be on file with the school administration. |
If it appears necessary to any of the parties involved, the administration, the person who made the complaint, and the employee involved may meet with the Board for the purpose of fuller study. The employee may request a closed session. A decision will be rendered by the Board of Education within fifteen (15) days.
| A. | Generally all parties involved and representatives, including the school administration, shall be asked to attend such a meeting for the purposes of presenting additional facts, making further explanations, and clarifying the issues. | ||
| B. | Hearsay and rumor shall be discounted as well as emotional feeling except as they directly relate to the facts of the situation. | ||
| C. | The Board shall conduct this meeting in as fair and just a manner as possible. | ||
| D. | The Board and the individual involved may request a disinterested third party to act as a moderator to help reach a mutually satisfactory solution. |
A parent, guardian, or other person who upbraids, insults, or abuses any employee in the presence or hearing of a student may be subject to legal action under the provisions of the School Code.
The above does not apply to the Superintendent, Legal Counsel or Auditor.
