In accordance with regulations outlined in Public Law 95-561, Sections 128, 168, and 184, the following procedures shall be followed in handling complaints regarding Title 1:
| | A. | Complaints shall generally be directed to the Superintendent of Schools; however, they may also be filed directly with the Deputy Commissioner of Education. |

| | B. | Resolution of a complaint directed to the Superintendent shall not exceed thirty (30) days, unless extended by the State Department of Education due to exceptional circumstances. |
|
| | C. | The Superintendent shall appoint a hearing panel composed of a representative from the District Parent Advisory Council, the Title I Director, and any other person so designated. |
|
| | | 1. | It shall be the responsibility of the hearing panel to clarify the issues and attempt to resolve the problem. |
|
| | | 2. | The hearing panel shall keep official records of all proceedings. |
|
| | | 3. | The complainant or the complainant's representative shall be given an opportunity to present evidence and question the parties involved. |
|
| | | 4. | A complaint that is not resolved to the complainant's satisfaction within ten (10) working days shall be referred back to the Superintendent of Schools. |
|
| | D. | Responsibilities of the Superintendent of Schools if the complaint is not resolved. |
|
| | | 1. | The Superintendent shall review the records, and, if necessary, request additional information within ten (10) working days. |
|
| | | 2. | The Superintendent shall clarify the issues and attempt to resolve them. |
|
| | | 3. | The Superintendent shall notify, in writing, the complainant of his/her resolution of the complaint. |
|
| | E. | The complainant has the right to appeal the resolution of the complaint to the Board of Education within ten (10) working days after receipt of the Superintendent's decision. |
|
| | F. | The complainant has the right to appeal the Board of Education's resolution of the complaint to the State Department of Education within thirty (30) days after the receipt of the Board's written decision. |
|
| | G. | Actual expenses incurred, in accordance with the local School District policies, may be a part of the local budget-for the Title I program, subject to review and approval by the Director of the Division of Federal Assistance. |
