5601 - STUDENT ACTIVITY CODE
Definition
:This code is applicable to students in any elective student activity. An elective student activity is any activity that meets, performs, or practices at times other than or in addition to the regular school day and school year. Activities that are required as a part of the regular school curriculum are excluded.
Although the Board of Education encourages compliance with the provisions of this code throughout the year, compliance is required during the school year and also at other times when students are engaged in an elective activity.
Philosophy
:We believe that elective school activities make school life richer and more rewarding and that adherence to certain behavior codes enhances an individual's pattern of living.
While students have no absolute rights or requirement to participate in an elective student activity, including athletic and other extra-curricular programs, it is a privilege encouraged by the School District and the Community.
We believe that the harmful effects of chemical use are well documented. The dangers of chemical use are taught throughout the health courses in our schools and this behavior code is consistent with our District's philosophy and curriculum.
Activity Behavior Code
:During the school year, defined to include all vacations, and the duration of the activity (which may include summer vacations), no student at any time or in any location, shall:
| A. | possess, use, sell, offer to sell, deliver, conceal, consume, or be under the influence or suffer some impairment as a result of the use of any drugs of abuse including alcoholic beverages or any counterfeit drugs of abuse. A student is subject to disciplinary action after the student has used or consumed any alcoholic beverage, intoxicant, or any of the drugs of abuse, and if s/he is found to have the smell of alcohol on his/her breath. | ||
| B. | instigate or conspire with others to sell, deliver, conceal, consume, or be under the influence of any drugs of abuse, including alcoholic beverages or any counterfeit drugs of abuse; | ||
| C. | use, conceal, sell, purchase, accept, or transmit any substances which are reasonably thought to be drugs of abuse, sold as drugs of abuse, or inferred by the seller or buyer to be mind altering substances or drugs of abuse; | ||
| D. | possess, use, transmit, or conceal any item which is designed for use with illegal cannabis or drugs of abuse; | ||
| E. | violate any Federal, State, or Municipal law or ordinance governing conduct not described in paragraph 1 through 4 above where the student should have reason to understand that such violation has or is likely to have a negative impact on the school or the school community; | ||
| F. | possess, conceal, sell, transmit, or use tobacco in any form, or conspire with others to conceal, sell, transmit, or use tobacco in any form while on school property or while in attendance at a school-sponsored or school-related activity; and | ||
| G. | be suspended from school, assigned to in-school suspension, or be expelled from school for violation of the Student Discipline Code. |
Disciplinary Action
:| A. | For activities which have a schedule of public playing dates or activities, a first (1st) violation of the Student Activity Code will result in removal from participation in 20% of the next scheduled public playing dates or activities. For activities which do not normally have a schedule of public playing dates or activities, a first (1st) violation of the Student Activity Code will result in removal from participation in the equivalent of 20% of the next scheduled activities, publications, events, or meetings, such equivalent to be determined by the advisor of the activity and the assistant principal. | ||
| B. | A second (2nd) violation during any school year will result in the removal of the student from participation in all extracurricular activities for the balance of that semester and the loss of the right to receive any awards that might result from the student's prior participation. | ||
| C. | A third (3rd) violation during any school year will result in the student's exclusion from participation in any school activities for the remainder of the school year. |
Students Voluntarily Seeking Help:
A student who voluntarily seeks help with any situation covered by this code prior to the imposition of any discipline under the schedule set forth above, at the discretion of the assistant principal, may be excused from full imposition of discipline, provided that the student voluntarily and fully participates, to the satisfaction of the assistant principal, in a program designed to help the student avoid such situations in the future. A current list of available programs will be given to each student found in violation of the behavior code.
Procedure For Implementation of Discipline
:| A. | Any participant in an extracurricular activity, including athletics, who is suspected of violating the Student Activity Code will be given written notice of the suspected violation and afforded the opportunity for a meeting with the head coach or advisor of the activity. In that meeting, the student will have a chance to respond to the charges. If the student admits a violation of the Student Activity Code, the coach or advisor, in accordance with the schedule set forth above, shall inform the student of the voluntary help options and of the duration of the participation exclusion should the student refuse to seek such help. | ||
| B. | If the student denies a violation of the Student Activity Code, s/he shall be afforded the opportunity for a hearing before a Review Board. The Review Board shall consist of the assistant principal, the athletic director, and one (1) other faculty member appointed by the principal. The assistant principal shall arrange for a hearing to be conducted within no more than two (2) school days of the meeting with the coach or advisor. The student is entitled to be accompanied by his/her parent or guardian at the hearing. The Review Board will consider arguments made on behalf of the student as well as evidence which supports the discipline. The decision of the Review Board shall be made in writing to the student and his/her parents within seventy-two (72) hours of the hearing. | ||
| C. | Any student may appeal a decision of the Review Board to the principal within five (5) school days of receipt of its decision. The principal shall meet with the student, his/her parents or guardian, and the coach or advisor and make a decision based upon the information there presented. The principal may affirm, reverse, or modify the ruling of the Review Board. The principal shall inform the student and his/her parents or guardian of the decision in writing within seventy-two (72) hours of the hearing. |
