4124 - EMPLOYMENT CONTRACT

The Board of Education requires for the mutual protection of the District and the classified staff member that every newly employed person in a classified position including regular hourly rate and per diem classified staff sign an employment contract for a period of not more than one (1) year.

The employment contract shall include the term for which employment is contracted, the salary, and such other matters as may be necessary to a full and complete understanding of the contract. In order to insure employment, the applicant must sign the contract and abide by the policies of the Board which pertain to him/her.

Classified staff who are rehired shall be offered a two (2) year contract. After completion of the two (2) year contract, if the classified staff member is rehired, the classified staff member shall be on a continuing contract and the salary provided in the last contract shall be matched or increased but may not be reduced unless such reduction is part of a uniform plan affecting all classified staff of the District.

Notice of contract renewal must be given annually to each classified staff member on or before June 1st.

Worker's Compensation

All personnel are covered by the insurance protection of Workman's Compensation Law for injury or death by external accidental means or accidental in character and result, received in the course of, and arising out of, the injured employee's employment.

Job Classifications

The Superintendent shall review annually specifications descriptive of the duties, responsibilities, requirements, and qualifications of each job classification.

Each employee of the District shall be notified of his/her classification when employed and following each change in classification.

Layoffs of Classified Employees

It is the responsibility of the Board to provide the staff necessary for the operation of the District, consistent with the responsibility of the Board to its constituency for the judicious allocation of its resource.

The Board reserves the right in accordance with statute to abolish any existing position in whole or in part or to reduce the number of employees in such positions.

The Superintendent shall recommend to the Board for its deliberation the abolishment of existing positions but nothing in this policy shall be considered to constrain the Board from exercising its authority unilaterally and without the recommendation of the Superintendent.

All classified personnel shall be selected for layoff in accordance with length of service in the District and/or past experience and diversified capabilities.

Breach of Contract

Each classified employee by the terms of his/her contract must perform such duties as are prescribed in his/her description and/or are deemed appropriate to his/her position during the employee's customary working hours and abide by and maintain the rules and regulations.

Violations of such regulations or non-performance of duties constitute a breach of contract.

An employee who violates the terms of his/her contract will be notified in writing of the charges against him/her and advised of his/her right to a hearing before the Board of Education within one (1) month of his/her request for such hearing. Such employee has the right to be represented by legal counsel. All efforts to follow procedures of due process will be made.
