3140 - TERMINATION AND RESIGNATION

TERMINATION

An employment contract may be suspended or terminated, upon a majority vote of the Board of Education, for reasonable and just cause such as gross inefficiency, immorality, willful and persistent violation of Board policy or District guidelines, or for disclosing a question to a student on a State proficiency test. In such cases, the Board shall abide by due process, statutory procedures, and such terms as may be set forth in a negotiated, collectively-bargained agreement.

RESIGNATION

A professional staff member may resign in accordance with the terms of the negotiated, collectively-bargained agreement or his/her employment contract.

An administrator may resign by filing a written resignation with the Superintendent at least thirty (30) days prior to the effective date of the resignation.

A resignation, once accepted by the Board, may not then be rescinded.

Termination of Contract by Teacher

No certificated employee shall terminate a contract after the tenth day of July of any school year or during the school year prior to the termination of the annual session, without the consent of the Board of Education. Such teacher may terminate his/her contract at any other time by giving five (5) days' written notice to the Board. Upon complaint of the Board of Education to the State Board of Education and after investigation by it, the certificate of a certified employee terminating his/her contract in any other manner may be suspended for not more than one (1) year.

PERSONNEL

Separation - Breach of Contract

The Board of Education will regard as a breach of contract on the part of a teacher in any of the following conditions:

 A.failure to carry out duties assigned by the proper administrator; this includes the assignment of extra-curricular activities

 B.unexcused absences from assigned work

 C.engaging in other employment in addition to service with the Ashtabula County Joint Vocational School Board of Education which interferes with the educational work for which the teacher has contracted. An example of this would be acceptance of a position by a teacher which would prevent him/her from attending faculty or committee meetings or other activities assigned by the proper administration

Immediate Dismissal

Immediate dismissal will result for any of the following:

 A.any improper relationship on the part of the employee with any school student

 B.evidence of perversion

 C.conviction of a felony

 D.deliberate falsification of application data

Retirement Compensation

Membership and Contributions

All certified employees are members of the State Teachers' Retirement System. The mandated percent for the employee's contribution will be withheld from each salary payment. The Board of Education will contribute the mandated percent. A statement is issued to each teacher annually by the State Teachers' Retirement Board stating the amount of his/her cumulative contribution and years of service.

Service Credit

Any member of the State Teachers' Retirement System who has five (5) years of service credit and had attained age sixty (60), or who has twenty-five (25) years of service credit and has attained age fifty-five (55), or who has thirty (30) years of service credit shall be granted service retirement after filing with the State Teachers' Retirement Board a completed application on the appropriate form.
