8442.01 - ILLNESS-OR-INJURY-IN-LINE-OF-DUTY LEAVE
Any employee shall be entitled to illness or injury-in-line-of-duty leave in connection with an injury received in the discharge of duties or because of illness from any contagious or infectious disease contracted in the performance of duties, excluding colds and influenza, for a period not to exceed ten (10) days. This leave is non-cumulative, and is provided through the workers' compensation law.
Conditions for Leave
| A. | The employee must provide written testimony or evidence that the illness or injury was received in the line of duty. For an illness, the employee must supply a letter from a medical doctor, who treated the patient, stating that in his/her opinion there is a strong probability that the illness was contracted at the work site. | ||
| B. | The employee must also supply a letter from the doctor excusing him/her from all work including light duty. | ||
| C. | The employee must file a written claim as outlined below. |
Claim
An employee who seeks compensation while absent because of injury or illness incurred in the line of duty shall file a claim in the manner prescribed by law and policy within five (5) working days following his/her return from such absence or as soon as possible following his/her injury or illness in line of duty. The Board may approve such claims and authorize the payment in accordance with the provisions of law.
Extent of Leave Available
Leave for any employee, as prescribed by law, shall be authorized for a total not to exceed ten (10) work days for the same illness or injury. The employee granted such leave is entitled to full pay status for a period not to exceed ten (10) working days.
If the employee is out because of an injury or illness-in-line-of-duty beyond ten (10) days and is receiving workers' compensation at the rate of two-thirds (2/3s) of his/her salary, the Board may approve illness-in-line-of-duty days to expand his/her net pay to 100% for a period not to exceed one (1) year per illness or injury.
Instructional or support staff who are members of a bargaining unit should refer to the negotiated agreement.
