7525 - LEASE AND LEASE-PURCHASE OF LAND, FACILITIES, AND EQUIPMENT

The Superintendent shall make recommendations to the Board regarding any offer received from a person or entity for the lease or lease-purchase of any land owned by the District. The prospective lessee shall state in writing how the land will be used for educational purposes. The Superintendent's recommendation shall include:

 A.the location and description of the land and its present use;

 B.the long-range plan for its use;

 C.the stated use of the land by the prospective lessee;

 D.the fair market value of the parcel, as determined pursuant to the State Board of Education Rules, when the land is to be released by a lease to purchase agreement;

 E.the terms and value to be received from the prospective lessee.

The Superintendent may recommend the acquisition of land, facilities, and equipment under lease or lease-purchase agreements under provision of F.S. 1013.15 through competitive bids or proposals. The Superintendent's recommendation shall include:

 A.such acquisition is in the best interest of the District;

 B.length and terms of such agreements;

 C.procedures for developing and approval of agreements;

 D.estimated annual costs and sources of funding;

 E.proposed schedule for any required public advertisements and hearings;

 F.all required written documents necessary for the execution and maintenance of agreements.

Prior to final action on the proposal for a lease or lease-purchase agreement, the Board shall consider approval of the agreement at a public meeting. At this meeting the proposed agreement, in its final form, shall be made available for inspection and review by the public.

Lease agreements do not constitute a debt, liability, or obligation of the State, or pledge the full faith and credit of the State or Board.
