4430 - LEAVES OF ABSENCE
A leave of absence is permission granted by the Board or allowed under its adopted policies for an employee to be absent from duty for a specified period of time with the right to return to employment upon the expiration of leave.
| A. | Leave may be with or without pay as provided by law, regulations of the State Board and this policy. For any absence that is without pay, the deduction for each day of absence shall be determined by dividing the annual salary by the number of days/hours for the employment period. |
| 1. | Paid leaves of absence may include: vacation, sick leave, personal charged to sick, jury duty/court service, temporary duty, illness or injury in line of duty, and military. | |||
| 2. | Unpaid leaves of absence may include: professional study, personal leave not paid, illness leave not paid, family and medical leaves, political, military, maternity/adoption and child rearing. |
| B. | Support staff members shall not be absent from their assigned duties except as authorized by the Superintendent or designated representative. A support staff member who is willfully absent from duty without leave shall forfeit compensation for the time of such absence. Appointments shall be subject to cancellation by the Board and s/he shall be subject to immediate dismissal. | ||
| In an emergency, the worksite supervisor may authorize the absence of an employee without pay for a period not to exceed two (2) days, provided such authorized absence should be immediately reported to the Superintendent. | |||
| C. | All leave shall expire no later than June 30th of each school year. When a second year of leave is being requested, the support staff member shall re-apply for leave to be effective July 1st of the following school year. No leave, except military leave and personal for purposes of teaching in a charter school, will be granted for a period in excess of two (2) years. | ||
| D. | Support staff members on unpaid leave of absence, except medical, may be used on a substitute basis. |
Application
A request for leave of absence shall be approved as set forth in Policy 4430.03, Approval of Leaves, prior to the effective date of the leave. Except in cases of emergency, the request shall be filed at least ten (10) days before the date on which the proposed leave is to become effective. Leave shall be used for the purposes set forth in the leave application.
Support staff should refer to these rules or the collective bargaining agreement for specific leave requirements.
The Superintendent shall develop procedures to implement leave provisions.
