3121 - CONDITIONS FOR EMPLOYMENT AND RE-EMPLOYMENT OF INSTRUCTIONAL STAFF

Applicants for employment or re-employment for instructional positions must be of good moral character, have attained the age of eighteen (18) years and meet those qualifications as established by the Board. Applicants must submit an employment application, a copy of the social security card with correct name, and a minimum of two (2) acceptable references. The applicant must provide verification of all prior employers for a minimum of the past five (5) years and all private and public educational institutions by which an applicant was previously employed while age eighteen (18) years or older. Applicants shall provide evidence that they have attained the educational level specified in the job description.

The Board employs only U.S. citizens and others lawfully authorized to work in the United States. The Superintendent shall verify all new full-time and part-time employees' right to work in the United States according to Federal law.

Candidates who have been offered a position must meet employment prerequisites including a negative drug screening and a Level 2 background screening, in accordance with applicable law and Policy 3124, Alcohol and Drug-Free Workplace, and Policy 3121.01, Criminal Background and Employment History Checks. Candidates must provide appropriate documents related to job requirements, employment, and benefits as specified in Employment Procedures.

Failure of the candidates to adhere to the time schedule established for submission of documents may be cause for failure to employ or for dismissal.

False or misleading statements or answers or omissions made by a person in connection with seeking employment may bar a person from employment with the Board or, if discovered after employment, may result in disciplinary action, including termination upon the recommendation of the Superintendent and the approval of the Board. Each case shall be considered on its own merits.

Each employee shall list his/her correct name and address with the District Human Resources Division and shall promptly notify that division when a name or address change occurs.

In accordance with F.S. 121.091(13), the Superintendent has the discretion to approve or disapprove the requests of Board employees who are K-12 instructional personnel as defined in F.S. 1012.01(2)(a) through (d) (i.e., classroom teachers, student personnel services, librarians/media specialists, and other instructional personnel) to extend their Deferred Retirement Option Program (DROP) period beyond sixty (60) months, up to a maximum of ninety-six (96) months. In exercising such discretion, the Superintendent shall consider the recommendations of the employees' site-based supervisors.

The Superintendent is directed to develop appropriate employment procedures governing the recruitment, screening, selection, appointment, and employment of all personnel consistent with Florida statutes, State Board of Education rules, Federal requirements, and Board policies.
