1020.01 - CONTRACT OF THE SUPERINTENDENT

The Superintendent of Schools shall be appointed by the Board. The Board shall enter into a contract of employment with the Superintendent for up to a maximum of four (4) years. Such contract shall include:

 A.the term for which employment is contracted, including beginning and ending dates;

 B.the salary which the Superintendent shall be paid and the intervals at which s/he shall be paid;

 C.the benefits to which s/he is entitled;

 D.such other matters as may be necessary to a full and complete understanding of the employment contract.

The Superintendent shall provide supervision directly and indirectly to all staff members and employees of the Board, and shall organize, re-organize, arrange, and direct the employees of the Board, as s/he deems to be in the best interest of the District. The responsibility for selection, placement, transfer, and/or promotions of personnel shall be vested in the Superintendent and his/her staff. All such powers, duties, and responsibilities are nevertheless subject to the approval of the Board in accordance with law and existing rules and regulations.

Throughout the term of the contract, the Superintendent shall be subject to discharge for good and just causes, and shall have a right to receive written notice of charges, notice of hearing, and a fair hearing before the Board. Notwithstanding the above, the Board may remove the Superintendent from the position of Superintendent of Schools for any reason so long as it fulfills and honors the salary and fringe benefit obligations of the contract.

As executive officer of the Board, the Superintendent shall not be subject to either general or special provisions of law which relate to tenure or continuing contracts of other school employees. The Superintendent's duties to the school system shall be as provided by law, State Board of Education rules and regulations, and by Board policies.
