5500.01 - EXTRA-CURRICULAR AND CO-CURRICULAR CODE OF CONDUCT

Philosophy

The Board of Education recognizes the value of interscholastic athletics, extra-curricular, and co-curricular activities in the educational process and the values that young people develop when they have the opportunity to participate in activities outside of the traditional classroom.

Participants involved in Board-approved extra-curricular and co-curricular activities are expected to demonstrate the same level of responsibility and behavior at practices, competitions, and events as are expected in the classroom. The Board further encourages the development and promotion of sportsmanship, ethics, and integrity in all phases of the educational extra-curricular and co-curricular process and in all segments of the community, including administrators, participants, adult supervisors, parents, spirit groups, and support/booster groups involved with extra-curricular and co-curricular activities.

Purpose

The purpose of this Code of Conduct is to give all students participating in extra-curricular and co-curricular activities and other persons a guide to the operation these activities in the District. Specific rules, regulations, policies, and procedures will be explained by the coaches and advisors of the various teams/activities within the District's athletic program and other District extra-curricular and co-curricular activities at the beginning of the season/school year. Students participating in these activities will be expected to adhere to not only the specific rules, regulations, policies, and procedures set forth in this code, but also specific rules provided by coaches and/or advisors for each extra-curricular/co-curricular activity and provided to the student as approved herein.

Extra-Curricular and Co-Curricular Activities

Extra-Curricular Activities

For the purpose of this Code of Conduct, extra-curricular activities are those activities approved by the Board both beyond and during the school day that have a District employee serving as an advisor and/or coach.

Extra-curricular activities shall include but are not limited to the following:

Co-Curricular Activities

For the purpose of this Code of Conduct, co-curricular activities shall include but not be limited to, the following:

 A.Band

 B.Orchestra

 C.Vocal Music

In the event a student is removed from a co-curricular activity, one (1) that involves a class grade, an alternate activity/assignment will be made available.

Extra-Curricular and Co-Curricular Rules and Regulations

This Extra-Curricular/Co-Curricular Code of Conduct and the Board's Student Code of Conduct shall apply to a student during the school year, including breaks, holidays, and weekends and during the time of officially recognized summer activities regardless of whether or not the student is on school property, attending a school function or activity, on private property, or at a private party.

For example, the Extra-Curricular/Co-Curricular Code of Conduct shall apply to football players on the first day of practice, which normally starts at the end of the summer and before the academic school year begins. However, the Extra-Curricular/Co-Curricular Code of Conduct does not apply to a basketball player who has never participated in athletics, extra-curricular, and/or co-curricular activities until the first day of basketball practice. The Student Code of Conduct would, however, begin on the first day of the school year. Furthermore, this Code of Conduct and the Student Code of Conduct will continue to apply to students after their participation in athletics, extra-curricular, and co-curricular activities for the remainder of the school year. Additionally, individual advisors'/coaches' rules shall govern a student's conduct during the season.

 A.The Student Code of Conduct and the Extra-Curricular/Co-Curricular Code of Conduct shall be posted in a central location.

 B.It must be understood by all students and their parents/guardians that a condition of participating in extra-curricular/co-curricular activities in the District is a commitment to follow the rules, regulations, policies, and procedures established by the District, its coaches and advisors for the implementation of its extra-curricular/co-curricular program. It must also be understood that a student who violates these rules, regulations, policies, and procedures shall face disciplinary action. Such disciplinary action may include removal from participation in extra-curricular/co-curricular activities and possible suspension or expulsion from school pursuant to the Student Code of Conduct and R.C. 3313.66. A student removed from participation in extra-curricular/co-curricular activities shall be given an informal hearing with the building principal or his/her designee prior to removal from the activity.

 C.All students who have been removed from participation for a season or longer shall forfeit any extra-curricular/co-curricular awards earned for the activity for that season from the District or any other association as a result of participation in the extra-curricular/co-curricular activity.

 D.Chronic offenses and/or major violations of this Code that may forfeit a student's privilege to participate in extra-curricular/co-curricular activities, as determined by the administration may include, but are not limited to:

  1.violations of the Student Code of Conduct;

  2.violations of school or athletic policies concerning drugs, alcohol, and tobacco including this Extra-Curricular/Co-Curricular Code of Conduct;

  3.disruptive behavior and misconduct at practices, games, activities, or during the course of activity-related transportation;

  4.disrespect to officials and/or school personnel before, during, or after an athletic contest, performance, and activity or at school;

  5.lack of participation in club sponsored events;

  6.failure to know and perform club duties;

  7.failure to return equipment owned by the Board;

  8.failure to maintain the academic requirements established by the Board and the Ohio High School Athletic Association;

  9.excessive unexcused absences and tardies from school;

  10.failure to attend required practices, performances, or athletic contests at specified times;

  11.participating in activities that might endanger the health, safety, or welfare of others;

  12.conviction of a violation of any State or community law.

Violations of Extra-Curricular Code of Conduct and Applications for Reinstatement

 A.First Offense/Incident:

  1.A student found to be in violation of the Extra-Curricular/Co-Curricular Code of Conduct shall be removed from participation in all activities and shall be ineligible for participation in extra-curricular/co-curricular activities for one (1) calendar year.

  2.A first time offender may apply for reinstatement to the Building Level Extra-Curricular/Co-Curricula Council but not be reinstated earlier than two (2) weeks after initial removal.

  3.Written requests for reinstatement shall be delivered to the building principal.

  4.Upon receipt of a written request by the student and/or his/her parents, the Building Level Extra-Curricular/Co-Curricular Council shall meet with student/parent(s) to consider reinstatement of eligibility.

 B.Multiple Offenses:

  1.A student determined to be in violation of the Extra-Curricular/Co-Curricular Code of Conduct a second time during their attendance/enrollment in the District, shall be removed from participation and shall be ineligible for participation in extra-curricular/co-curricular activities for a minimum of one (1) calendar year.

  2.A student found to be in violation of the Extra-Curricular/Co-Curricular Code of Conduct a second time during their attendance/enrollment in the District may be eligible for reinstatement by applying for reinstatement to the Building Level Extra-Curricular/Co-Curricular Council. The Building Level Extra-Curricular/Co-Curricular Council shall have no authority to reinstate the student until the expiration of one (1) calendar year after the initial removal of the student's eligibility.
   Under this section, a student requesting reinstatement of extra-curricular/co-curricular eligibility may not apply for said reinstatement until ninety (90) days prior to the expiration of their removal from eligibility.

  3.A student found to be in violation of the Extra-Curricular/Co-Curricula Code of Conduct more than two (2) times during their attendance/enrollment in the District in grades 7 through 12 shall be permanently removed from participation in interscholastic athletics, extra-curricular, and co-curricular activities and shall not be permitted to apply for reinstatement.

Eligibility/Participation Reinstatement Application

This Code of Conduct establishes a reinstatement program that may permit a student to apply for reinstatement of their extra-curricular/co-curricular eligibility/participation. Such applications shall be made to the appropriate Building Level Extra-Curricular/Co-Curricular Council.

 A.Depending on the nature, extent, and frequency of the student's conduct, the student may, within the timelines and guidelines established by this Code and the Council, apply for reinstatement of his/her extra-curricular/co-curricular eligibility.

 B.The Council, upon receipt of a student's and/or parent's valid written request for reinstatement, shall convene a meeting to consider an application for reinstatement.

  1.Such meeting shall take place within ten (10) school days after the Council's receipt of the written request.

  2.A first time offender may apply for reinstatement to the Building Level Extra-Curricular/Co-Curricular Council not earlier than two (2) weeks after initial removal. The Building Level Extra-Curricular/Co-Curricular Council is precluded from reinstating eligibility to participate in any interscholastic competition, including, but not limited to, scrimmages, until such time that the student has forfeited his/her privilege to participate in at least one (1) Ohio High School Athletic Association's sanctioned and scheduled regular season and/or playoff contest, game, or event.

  3.The student and parents are permitted to have a representative of their choice at the meeting.

  4.The Council is permitted to have representation and may invite other relevant persons to the meeting.

  5.The Council may order follow-up meetings.

Self-Referral Policy

A student who has not previously been determined to have violated the Extra-Curricular/Co-Curricular Code of Conduct may voluntarily seek assistance for dealing with an alcohol or drug abuse problem by self-referral to their coach, athletic director, or school administrator. A student is not eligible for self-referral if the referral is to avoid consequences of violation of this policy or to report said conduct to the administrator prior to the administration's receipt of information concerning the violation from a third party (e.g., self-referral does not intend to include those times when a student comes froward to self-report a violation(s) to administrators because the student or parties believe that it is likely that the administration will receive information from a third party about the alleged violation or incident. However, a student's self-reporting of violations will be considered a positive mitigating circumstance or factor which will likely result in a Building Level Extra-Curricular/Co-Curricular Council consideration upon application for reinstatement.).

Any decisions regarding a student's utilization of these self-referral provisions shall be at the sole discretion of the administration, taking into consideration all relevant factors, on a case-by-case basis. Such factors include, but are not limited to, the nature and frequency of the student's conduct, the student's character, remedial actions of students, counseling, etc. A student may only utilize this self-referral policy one (1) time during middle school (grades 7-8). Additionally, a student may also be eligible for self-referral during grades 9-12. Self-referrals that result in no removal from participation shall still be considered a first violation of the Extra-Curricular/Co-Curricular Code of Conduct in the event of a subsequent violation.

If a self-referral student agrees to participate in an educational program approved by the Building Level Extra-Curricular/Co-Curricular Council, the student may be permitted to continue to participate in extra-curricular/co-curricular activities depending upon the student's mental and physical condition and the nature and circumstances of the student's drug or alcohol problem. The educational program may consist of, but not necessarily be limited to, assessment, counseling, and community service. Refusal or failure to complete the required educational program will result in the full penalty as provided for in this Extra-Curricular/Co-Curricular Code of Conduct.

Additional Rules for Specific Activities

Additional rules and regulations, consistent with this Extra-Curricular/Co-Curricular Code, may be developed by the coach or advisor for each sport or activity. Coaches'/Advisors' rules must be approved by the building principal or designee prior to issuance to students. Such rules and regulations shall be in writing and provided to each student participating in extra-curricular/co-curricular activities at the start of the season. Each coach/advisor may also impose reasonable punishment on a student found in violation of the coach's/advisor's rules and regulations.

Extra-Curricular Councils

The Superintendent has established an Extra-Curricular/Co-Curricular Council at the Building Level in order to administer and enforce the Board's Extra-Curricular/Co-Curricular Code of Conduct. This Council shall also conduct reinstatement meetings that, in certain circumstances, may be utilized by the student to apply for reinstatement of eligibility/participation with the District.

 A.Building Level Council
  A Building Level Extra-Curricular/Co-Curricular Council shall be established at both the high school and middle school. The Council shall consist of the building principal or designee, and any combination of the building's athletic director, staff member, and a coach or advisor. Each Building Level Extra-Curricular/Co-Curricular Council may invite a school guidance counselor and/or other team member to participate and provide input in the consideration of a student's application for reinstatement. The Building Level Extra-Curricular/Co-Curricular Council shall consider an review applications for reinstatement.

 B.The Council, upon receipt of a student's application for reinstatement, shall meet with the student and the student's parents/guardians and may consider all relevant factors in determining whether the student's eligibility/participation shall be reinstated and what conditions, if any, shall apply to the reinstatement. Such factors shall include, but are not limited to, the student's character, behavior, academic record, school discipline record, nature and frequency of conduct, remedial actions of the student, counseling, the student's level of honesty and cooperation with administrators including sharing of relevant information with administrators related to the incident or rule violation and/or the student's self-reporting of a violation of the code. Additionally, the Council shall have the sole discretionary authority to order conditions precedent to reinstatement including, but not limited to, assessment, counseling, community service, team apologies, random drug and alcohol testing at the student's expense. In the event the Council establishes conditions precedent to reinstatement, the Council shall have the sole discretionary authority to determine if such contingencies and conditions have been satisfied prior to ordering reinstatement of a student's eligibility to participate in extra-curricular/co-curricular activities.

 C.The Building Level Extra-Curricular/Co-Curricular Council shall establish administrative guidelines for the reinstatement process, the conduct of meetings, and a review of a student's extra-curricular/co-curricular eligibility/participation. Such guidelines shall be presented to the Superintendent for approval. Any revisions and/or modifications to the procedural guidelines must also be approved by the Superintendent.

 D.The orders and determinations of the Building Level Extra-Curricular/Co-Curricular Council shall be final and binding. There shall be no appeal to the Superintendent and/or Board.
