5540 - INTERVIEWING OF STUDENTS BY COMMUNITY AGENCIES

The School Board is committed to protecting students from individuals not associated with the school system but also recognizes its responsibility to cooperate with law enforcement and social service agencies.

When such agencies request permission to meet with a student at school, the principal/designee may grant permission for such interview only after consent of parent, guardian, or student if eighteen (18) or over. The principal/designee may refuse access to certain agencies when it is disruptive to the educational program. In these cases, agencies may be asked to return at a designated time.

Exceptions include:

 A.investigations of suspected child abuse or neglect, and

 B.investigations of criminal activity.

In these cases the law permits the Department of Children and Families staff and law enforcement officers to question students on school grounds without parental consent. Whenever feasible and appropriate an attempt will be made to notify parent(s) regarding such interviews.

Conversations with students at school may be recorded on tape (audio and/or video) only with prior notification to the student.

Nothing here shall prohibit access to students:

 A.by persons conducting protective investigations under the authority of F.S. Chapter 39;

 B.by law enforcement agents investigating crimes which may have occurred on school property or in the course of school-related activities; or

 C.when otherwise required by law.

The Superintendent shall establish District administrative procedures for granting permission to agencies to meet with students on school grounds.
